USE OF OUR WEBSITES IS GOVERNED BY THESE TERMS OF USE

These Terms of Use for the Lidl, LLC websites and mobile applications ("Terms of Use") apply to the websites, web pages, and mobile applications owned by Lidl that include a link to this document (collectively, the "Sites"). The Sites are operated by Lidl, LLC and its affiliates ("Lidl"). Throughout the Sites, the terms "you," "your," and "user" refer to you, the user; the terms "we," "us," and "our" refer to Lidl.

Lidl makes the Sites, including all information, applications, tools, and services available on or through the Sites, available to you subject to your acceptance of all the terms and conditions set forth herein. Your use of any Site constitutes your acceptance of these Terms of Use for all Sites. IF YOU DO NOT AGREE TO ALL OF THESE TERMS OF USE, YOU MUST IMMEDIATELY DISCONTINUE YOUR USE OF THE SITES AND MUST NOT CREATE AN ACCOUNT WITH LIDL.

CHANGES TO THESE TERMS OF USE

Lidl may revise and update these Terms of Use (in whole or in part) at any time, at its sole discretion, by posting them on the Sites. All changes become effective immediately upon posting and apply to your access to and use of the Sites from that date forward. Your continued use of the Sites after the revised Terms of Use have been posted constitutes your acceptance of the changes. You should review these Terms of Use regularly to remain informed of any updates, as they are binding on your continued use of the Sites.

USER REPRESENTATIONS AND WARRANTIES

You represent and warrant to Lidl that you will use the Sites in accordance with:

(i) these Terms of Use; and

(ii) all applicable laws, rules, and regulations.

LIMITED LICENSE TO USE

Subject to these Terms of Use, Lidl grants you a revocable, limited, non-exclusive, personal, and non-transferable license to:

(a) download, install, and/or use the Sites for your personal and non-commercial use; and

(b) access, stream, download, reproduce, and/or use the content and services available through the Sites strictly in accordance with these Terms of Use.

Lidl reserves the right, at its sole discretion, to suspend, restrict, and/or terminate your access to or use of the Sites at any time without prior notice. Such suspension, restriction, or termination shall not constitute a waiver of, nor affect, any other rights or remedies available to Lidl under applicable law or equity.

Except as expressly permitted by these Terms of Use, you shall not:

(i) copy any Site;

(ii) modify, translate, adapt, or create derivative works from any Site;

(iii) reverse engineer, decompile, or attempt to obtain the source code of any Site;

(iv) remove any copyright, trademark, or proprietary notices;

(v) rent, lease, sublicense, sell, or distribute the Sites;

(vi) circumvent or interfere with any security measures;

(vii) use contact information for unauthorized purposes;

(viii) introduce malware or otherwise interfere with the operation of the Sites;

(ix) use the Sites or their content for commercial purposes;

(x) engage in fraudulent activities;

(xi) defame, harass, or infringe upon the rights of third parties;

(xii) disrupt or interfere with the operation of the Sites.

The Sites are licensed, not sold. You acquire no ownership rights in the Sites or their content.

TRADEMARKS AND INTELLECTUAL PROPERTY

The trademarks, names, logos, designs, and slogans displayed on the Sites are owned by Lidl or authorized third parties. No license to use any trademark is granted without prior written permission.

The Sites and all content contained therein are protected by copyright laws. Lidl and its licensors retain all rights related to such content.

REWARDS PROGRAM

Lidl may occasionally offer opportunities to earn rewards subject to specific terms ("Reward Communications"). To receive a reward, you must comply with the requirements specified in the applicable Reward Communication.

LIDL REWARDS PROGRAM

The Lidl Rewards Program ("Rewards Program") allows customers to earn benefits by creating a myLidl account.

To participate, you must register by providing information such as your name, email address, mailing address, telephone number, date of birth, and marketing preferences.

Rewards are earned through "visits" to Lidl stores located in the United States, including:

• Store visits;
• Eligible purchases;
• Registering your account at checkout using the mobile application or your telephone number.

Rewards generally consist of dollar-off or percentage-off coupons applicable to selected products or specific product categories. The applicable terms, promotional periods, and limitations are described in each Reward Communication.

Rewards are credited to your myLidl account and must be redeemed in physical Lidl stores. They are not valid for purchases made through delivery services such as Shipt.

The Rewards Program is personal, non-transferable, and intended solely for non-commercial use. Lidl may suspend or terminate accounts for violations of these Terms, fraudulent activity, the creation of multiple accounts, or prolonged inactivity.

Lidl reserves the right to modify or terminate the Rewards Program at any time without prior notice.

THIRD-PARTY MATERIALS

The Sites may contain links to or content provided by third parties. Lidl is not responsible for the accuracy, legality, availability, or content of such third-party materials. Your access to third-party content is entirely at your own risk.

INFORMATION AVAILABLE ON THE SITES

Products advertised may not be available in every store. Online prices may differ from prices available in physical stores. Lidl does not guarantee the accuracy, completeness, or timeliness of any information available on the Sites.

The information provided is for general informational purposes only. You are responsible for verifying all information before making any decisions based upon it.

COLLECTION AND USE OF INFORMATION

Lidl may use automatic technologies (such as cookies) to collect information regarding your use of the Sites. By using the Sites, you consent to such collection and processing in accordance with the Privacy Policy.

USER-SUBMITTED CONTENT

You are solely responsible for any content you submit. By providing such content, you grant Lidl a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, distribute, and otherwise utilize that content. You represent and warrant that you possess all necessary rights to the content you submit.

ACCOUNT CREATION AND PASSWORD

Certain features require registration. You agree to provide accurate information and maintain the confidentiality of your password. You are responsible for all activities conducted through your account.

HEALTH-RELATED CONTENT

Information concerning health, wellness, nutrition, or cosmetic products is provided solely for informational purposes and does not replace professional medical advice.

DISCLAIMER OF WARRANTIES

The Sites are provided "AS IS" and "AS AVAILABLE." Lidl makes no warranties or representations regarding uninterrupted operation, freedom from errors, viruses, completeness, or accuracy of the information available through the Sites.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Lidl shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or relating to your use of the Sites. In no event shall Lidl's total liability exceed USD $100.

INDEMNIFICATION

You agree to indemnify and hold Lidl harmless from any claims, liabilities, damages, losses, or expenses arising out of your use of the Sites, your violation of these Terms of Use, or any content you provide.

ELECTRONIC COMMUNICATIONS

Lidl may communicate with you electronically. You agree that such electronic communications satisfy any legal requirements that communications be in writing.

GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Commonwealth of Virginia, United States.

Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Arlington, Virginia.

Any legal action must be commenced within one (1) year after the cause of action arises.

ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Lidl regarding your use of the Sites.

SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

WAIVER

Failure to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.
